1. 개요


1967년 만들어져 현재까지 유효한 우주 관련 조약으로, 정식 명칭은 '과 기타 천체를 포함한 외기권(외우주)의 탐색과 이용에 있어서의 국가활동을 규율하는 원칙에 관한 조약(Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and the Other Celestial Bodies)' 이다. 이는 지구 밖 영역을 상정한 조약으로는 최초로 대규모로 조인한 것이며 무려 107개 나라가 참여하고 있다. 1967년 1월 27일 3국의 주도로 워싱턴 D.C., 런던모스크바에서 조약문을 작성하였으며, 그 해 10월 10일 발효되었다. 대한민국은 3일 뒤인 10월 13일 서명하면서 조약에 참여하게 되었다.

2. 내용


조약 전문은 다음과 같다.
달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서의 국가활동을 규율하는 원칙에 관한 조약
전문
이 조약의 당사국은,
외기권에 대한 인간의 진입으로써 인류앞에 전개된 위대한 전망에 고취되고, 평화적 목적을 위한 외기권의 탐색과 이용의 발전에 대한 모든 인류의 공동이익을 인정하고,
외기권의 탐색과 이용은 그들의 경제적 또는 과학적 발달의 정도에 관계없이 전인류의 이익을 위하여 수행되어야 한다고 믿고,
평화적 목적을 위한 외기권의 탐색과 이용의 과학적 및 법적 분야에 있어서 광범위한 국제적 협조에 기여하기를 열망하고,
이러한 협조가 국가와 인민간의 상호 이해증진과 우호적인 관계를 강화하는데 기여할 것임을 믿고,
1963년 12월 13일에 국제연합 총회에서 만장일치로 채택된 "외기권의 탐색과 이용에 있어서의 국가의 활동을 규율하는 법적 원칙의 선언"이라는 표제의 결의 1962(ⅩⅤⅢ)를 상기하고,
1963년 10월 17일 국제연합 총회에서 만장일치로 채택되고, 국가에 대하여 핵무기 또는 기타 모든 종류의 대량파괴 무기를 가지는 어떠한 물체도 지구주변의 궤도에 설치하는 것을 금지하고,
또는 천체에 이러한 무기를 장치하는 것을 금지하도록 요구한 결의 1884(ⅩⅤⅢ)를 상기하고,
평화에 대한 모든 위협, 평화의 파괴 또는 침략행위를 도발 또는 고취하기 위하여 또는 도발 또는 고취할 가능성이 있는 선전을 비난한 1947년 11월 3일의 국제연합총회결의 110(Ⅱ)을 고려하고 또한 상기 결의가 외기권에도 적용됨을 고려하고,
달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서의 국가 활동을 규율하는 원칙에 관한 조약이 국제연합헌장의 목적과 원칙을 증진시킬 것임을 확신하여,
아래와 같이 합의하였다.
제1조
과 기타 천체를 포함한 외기권의 탐색과 이용은 그들의 경제적 또는 과학적 발달의 정도에 관계없이 모든 국가의 이익을 위하여 수행되어야 하며 모든 인류의 활동 범위이어야 한다.
달과 기타 천체를 포함한 외기권은 종류의 차별없이 평등의 원칙에 의하여 국제법에 따라 모든 국가가 자유로이 탐색하고 이용하며 천체의 모든 영역에 대한 출입을 개방한다.
달과 기타 천체를 포함한 외기권에 있어서의 과학적 조사의 자유가 있으며 국가는 이러한 조사에 있어서 국제적인 협조를 용이하게 하고 장려한다.
제2조
달과 기타 천체를 포함한 외기권은 주권의 주장에 의하여 또는 이용과 점유에 의하여 또는 기타 모든 수단에 의한 국가 전용의 대상이 되지 아니한다.
제3조
본 조약의 당사국은 외기권의 탐색과 이용에 있어서의 활동을 국제연합헌장을 포함한 국제법에 따라 국제평화와 안전의 유지를 위하여 그리고 국제적 협조와 이해를 증진하기 위하여 수행하여야 한다.
제4조
본 조약의 당사국은 지구주변의 궤도에 핵무기 또는 기타 모든 종류의 대량파괴 무기를 설치하지 않으며, 천체에 이러한 무기를 장치하거나 기타 어떠한 방법으로든지 이러한 무기를 외기권에 배치하지 아니할 것을 약속한다.
달과 천체는 본 조약의 모든 당사국에 오직 평화적 목적을 위하여서만 이용되어야 한다. 천체에 있어서의 군사기지, 군사시설 및 군사요새의 설치, 모든 형태의 무기의 실험 그리고 군사연습의 실시는 금지되어야 한다. 과학적 조사 또는 기타 모든 평화적 목적을 위하여 군인을 이용하는 것은 금지되지 아니한다. 달과 기타 천체의 평화적 탐색에 필요한 어떠한 장비 또는 시설의 사용도 금지되지 아니한다.
제5조
본 조약의 당사국은 우주인을 외기권에 있어서의 인류의 사절로 간주하며 사고나 조난의 경우 또는 다른 당사국의 영역이나 공해상에 비상착륙한 경우에는 그들에게 모든 가능한 원조를 제공하여야 한다.
우주인이 이러한 착륙을 한 경우에는, 그들은 그들의 우주선의 등록국에 안전하고도 신속하게 송환되어야 한다.
외기권과 천체에서의 활동을 수행함에 있어서 한 당사국의 우주인은 다른 당사국의 우주인에 대하여 모든 가능한 원조를 제공하여야 한다.
본 조약의 당사국은 본 조약의 다른 당사국 또는 국제연합 사무총장에 대하여 그들이 달과 기타 천체를 포함한 외기권에서 발견한 우주인의 생명과 건강에 위험을 조성할 수 있는 모든 현상에 관하여 즉시 보고하여야 한다.
제6조
본 조약의 당사국은 달과 기타 천체를 포함한 외기권에 있어서 그 활동을 정부기관이 행한 경우나 비정부 주체가 행한 경우를 막론하고, 국가활동에 관하여 그리고 본 조약에서 규정한 조항에 따라서 국가활동을 수행할 것을 보증함에 관하여 국제적 책임을 져야 한다. 달과 기타 천체를 포함한 외기권에 있어서의 비정부 주체의 활동은 본 조약의 관계 당사국에 의한 인증과 계속적인 감독을 요한다. 달과 기타 천체를 포함한 외기권에 있어서 국제기구가 활동을 행한 경우에는, 본 조약에 의한 책임은 동 국제기구와 이 기구에 가입하고 있는 본 조약의 당사국들이 공동으로 부담한다.
제7조
달과 기타 천체를 포함한 외기권에 물체를 발사하거나 또는 그 물체를 발사하여 궤도에 진입케 한 본 조약의 각 당사국과 그 영역 또는 시설로부터 물체를 발사한 각 당사국은 지상, 공간 또는 달과 기타 천체를 포함한 외기권에 있는 이러한 물체 또는 동 물체의 구성부분에 의하여 본 조약의 다른 당사국 또는 그 자연인 또는 법인에게 가한 손해에 대하여 국제적 책임을 진다.
제8조
외기권에 발사된 물체의 등록국인 본 조약의 당사국은 동 물체가 외기권 또는 천체에 있는 동안, 동 물체 및 동 물체의 인원에 대한 관할권 및 통제권을 보유한다. 천체에 착륙 또는 건설된 물체와 그 물체의 구성부분을 포함한 외기권에 발사된 물체의 소유권은 동 물체가 외기권에 있거나 천체에 있거나 또는 지구에 귀환하였거나에 따라 영향을 받지 아니한다. 이러한 물체 또는 구성부분이 그 등록국인 본 조약 당사국의 영역밖에서 발견된 것은 동 당사국에 반환되며 동 당사국은 요청이 있는 경우 그 물체 및 구성부분의 반환에 앞서 동일물체라는 자료를 제공하여야 한다.
제9조
달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서 본 조약의 당사국은 협조와 상호 원조의 원칙에 따라야 하며, 본 조약의 다른 당사국의 상응한 이익을 충분히 고려하면서 달과 기타 천체를 포함한 외기권에 있어서의 그들의 활동을 수행하여야 한다. 본 조약의 당사국은 유해한 오염을 회피하고 또한 지구대권외적 물질의 도입으로부터 야기되는 지구 주변에 불리한 변화를 가져오는 것을 회피하는 방법으로 달과 천체를 포함한 외기권의 연구를 수행하고, 이들의 탐색을 행하며 필요한 경우에는 이 목적을 위하여 적절한 조치를 채택하여야 한다. 만약, 달과 기타 천체를 포함한 외기권에서 국가 또는 그 국민이 계획한 활동 또는 실험이 달과 기타 천체를 포함한 외기권의 평화적 탐색과 이용에 있어서 다른 당사국의 활동에 잠재적으로 유해한 방해를 가져올 것이라고 믿을 만한 이유를 가지고 있는 본 조약의 당사국은 이러한 활동과 실험을 행하기 전에 적절한 국제적 협의를 가져야 한다. 달과 기타 천체를 포함한 외기권에서 다른 당사국이 계획한 활동 또는 실험이 달과 기타 천체를 포함한 외기권의 평화적 탐색과 이용에 잠재적으로 유해한 방해를 가져올 것이라고 믿을만한 이유를 가지고 있는 본 조약의 당사국은 동 활동 또는 실험에 관하여 협의를 요청할 수 있다.
제10조
달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서 본 조약의 목적에 합치하는 국제적 협조를 증진하기 위하여 본 조약의 당사국은 이들 국가가 발사한 우주 물체의 비행을 관찰할 기회가 부여되어야 한다는 본 조약의 다른 당사국의 요청을 평등의 원칙하에 고려하여야 한다. 관찰을 위한 이러한 기회의 성질과 기회가 부여될 수 있는 조건은 관계국가간의 합의에 의하여 결정되어야 한다.
제11조
외기권의 평화적 탐색과 이용에 있어서의 국제적 협조를 증진하기 위하여 달과 기타 천체를 포함한 외기권에서 활동을 하는 본 조약의 당사국은 동 활동의 성질, 수행, 위치 및 결과를 실행 가능한 최대한도로 일반 대중 및 국제적 과학단체 뿐만 아니라 국제연합 사무총장에 대하여 통보하는데 동의한다. 동 정보를 접수한 국제연합 사무총장은 이를 즉각적으로 그리고 효과적으로 유포하도록 하여야 한다.
제12조
달과 기타 천체상의 모든 배치소, 시설, 장비 및 우주선은 호혜주의 원칙하에 본 조약의 다른 당사국대표에게 개방되어야 한다. 그러한 대표들에 대하여 안전을 보장하기 위하여 그리고 방문할 설비의 정상적인 운영에 대한 방해를 피하기 위한 적절한 협의를 행할 수 있도록 하고 또한 최대한의 예방수단을 취할 수 있도록 하기 위하여 방문 예정에 관하여, 합리적인 사전통고가 부여되어야 한다.
제13조
본 조약의 규정은 본 조약의 단일 당사국에 의하여 행해진 활동이나 또는 국제적 정부간 기구의 테두리내에서 행해진 경우를 포함한 기타 국가와 공동으로 행해진 활동을 막론하고, 달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서의 본 조약 당사국의 활동에 적용된다.
달과 기타 천체를 포함한 외기권의 탐색과 이용에 있어서 국제적 정부간 기구가 행한 활동에 관련하여 야기되는 모든 실제적 문제는 본 조약의 당사국이 적절한 국제기구나 또는 본 조약의 당사국인 동 국제기구의 1 또는 2이상의 회원국가와 함께 해결하여야 한다.
제14조
본 조약은 서명을 위하여 모든 국가에 개방된다. 본 조 제3항에 따라 본 조약 발효이전에 본 조약에 서명하지 아니한 국가는 언제든지 본 조약에 가입할 수 있다.
본 조약은 서명국가에 의하여 비준되어야 한다. 비준서와 가입서는 기탁국 정부로 지정된 아메리카합중국 정부, 대영연합왕국 정부 및 소비에트 사회주의 공화국 연방 정부에 기탁되어야 한다.
본 조약은 본 조약에 의하여 기탁국 정부로 지정된 정부를 포함한 5개국 정부의 비준서 기탁으로써 발효한다.
본 조약의 발효후에 비준서 또는 가입서를 기탁한 국가에 대하여는 그들의 비준서 또는 가입서의 기탁일자에 본 조약이 발효한다.
기탁국 정부는 본 조약의 각 서명일자, 각 비준서 및 가입서의 기탁일자, 본 조약의 발효일자 및 기타 통고를 모든 서명국 및 가입국에 대하여 즉시 통고한다.
본 조약은 국제연합헌장 제102조에 따라 기탁국 정부에 의하여 등록되어야 한다.
제15조
본 조약의 당사국은 본 조약에 대한 개정을 제의할 수 있다. 개정은 본 조약 당사국의 과반수가 수락한 때에 개정을 수락한 본 조약의 각 당사국에 대하여 효력을 발생한다. 그 이후에는 본 조약을 나머지 각 당사국에 대하여 동 당사국의 수락일자에 발효한다.
제16조
본 조약의 모든 당사국은 본 조약 발효 1년후에 기탁국 정부에 대한 서면통고로써 본 조약으로부터의 탈퇴통고를 할 수 있다. 이러한 탈퇴는 탈퇴통고의 접수일자로부터 1년후에 효력을 발생한다.
제17조
영어, 노어, 불어, 서반아어중국어본이 동등히 정본인 본 조약은 기탁국 정부의 보관소에 기탁되어야 한다. 본 조약의 인증등본은 기탁국 정부에 의하여 서명국 정부 및 가입국 정부에 전달되어야 한다.
서명
이상의 증거로 정당하게 권한을 위임받은 아래 서명자가 이 조약에 서명하였다.
1967년 1월 27일 워싱톤, 런던 및 모스코바에서 3통을 작성하였다.

Preamble
Treaty on principles governing the activities of states in the exploration and use of outer space, including the moon and other celestial bodies.
Opened for signature at Moscow, London, and Washington on 27 January, 1967
THE STATES PARTIES. TO THIS TREATY,
INSPIRED by the great prospects opening up before mankind as a result of man's entry into outer space,
RECOGNIZING the common interest of all mankind in the progress of the exploration and use of outer space for peaceful purposes,
BELIEVING that the exploration and use of outer space should be carried on for the benefit of all peoples irrespective of the degree of their economic or scientific development,
DESIRING to contribute to broad international co-operation in the scientific as well as the legal aspects of the exploration and use of outer space for peaceful purposes,
BELIEVING that such co-operation will contribute to the development of mutual understanding and to the strengthening of friendly relations between States and peoples,
RECALLING resolution 1962 (XVIII), entitled "Declaration of Legal Principles Governing the Activities of States in the Exploration and Use of Outer Space", which was adopted unanimously by the United Nations General Assembly on 13 December 1963,
RECALLING resolution 1884 (XVIII), calling upon States to refrain from placing in orbit around the earth any objects carrying nuclear weapons or any other kinds of weapons of mass destruction or from installing such weapons on celestial bodies, which was adopted unanimously by the United Nations General Assembly on 17 October 1963,
TAKING account of United Nations General Assembly resolution 110 (II) of 3 November 1947, which condemned propaganda designed or likely to provoke or encourage any threat to the peace, breach of the peace or act of aggression, and considering that the aforementioned resolution is applicable to outer space,
CONVINCED that a Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies, will further the Purposes and Principles of the Charter of the United Nations,
Articles
HAVE AGREED ON THE FOLLOWING:
Article I
The exploration and use of outer space, including the moon and other celestial bodies, shall be carried out for the benefit and in the interests of all countries, irrespective of their degree of economic or scientific development, and shall be the province of all mankind.
Outer space, including the moon and other celestial bodies, shall be free for exploration and use by all States without discrimination of any kind, on a basis of equality and in accordance with international law, and there shall be free access to all areas of celestial bodies.
There shall be freedom of scientific investigation in outer space, including the moon and other celestial bodies, and States shall facilitate and encourage international co-operation in such investigation.
Article II
Outer space, including the moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.
Article III
States Parties to the Treaty shall carry on activities in the exploration and use of outer space, including the moon and other celestial bodies, in accordance with international law, including the Charter of the United Nations, in the interest of maintaining international peace and security and promoting international co- operation and understanding.
Article IV
States Parties to the Treaty undertake not to place in orbit around the earth any objects carrying nuclear weapons or any other kinds of weapons of mass destruction, install such weapons on celestial bodies, or station such weapons in outer space in any other manner.
The moon and other celestial bodies shall be used by all States Parties to the Treaty exclusively for peaceful purposes. The establishment of military bases, installations and fortifications, the testing of any type of weapons and the conduct of military manoeuvres on celestial bodies shall be forbidden. The use of military personnel for scientific research or for any other peaceful purposes shall not be prohibited. The use of any equipment or facility necessary for peaceful exploration of the moon and other celestial bodies shall also not be prohibited.
Article V
States Parties to the Treaty shall regard astronauts as envoys of mankind in outer space and shall render to them all possible assistance in the event of accident, distress, or emergency landing on the territory of another State Party or on the high seas. When astronauts make such a landing, they shall be safely and promptly returned to the State of registry of their space vehicle.
In carrying on activities in outer space and on celestial bodies, the astronauts of one State Party shall render all possible assistance to the astronauts of other States Parties.
States Parties to the Treaty shall immediately inform the other States Parties to the Treaty or the Secretary-General of the United Nations of any phenomena they discover in outer space, including the moon and other celestial bodies, which could constitute a danger to the life or health of astronauts.
Article VI
States Parties to the Treaty shall bear international responsibility for national activities in outer space, including the moon and other celestial bodies, whether such activities are carried on by governmental agencies or by non-governmental entities, and for assuring that national activities are carried out in conformity with the provisions set forth in the present Treaty. The activities of non-governmental entities in outer space, including the moon and other celestial bodies, shall require authorization and continuing supervision by the appropriate State Party to the Treaty. When activities are carried on in outer space, including the moon and other celestial bodies, by an international organization, responsibility for compliance with this Treaty shall be borne both by the international organization and by the States Parties to the Treaty participating in such organization.
Article VII
Each State Party to the Treaty that launches or procures the launching of an object into outer space, including the moon and other celestial bodies, and each State Party from whose territory or facility an object is launched, is internationally liable for damage to another State Party to the Treaty or to its natural or juridical persons by such object or its component parts on the Earth, in air space or in outer space, including the moon and other celestial bodies.
Article VIII
A State Party to the Treaty on whose registry an object launched into outer space is carried shall retain jurisdiction and control over such object, and over any personnel thereof, while in outer space or on a celestial body. Ownership of objects launched into outer space, including objects landed or constructed on a celestial body, and of their component parts, is not affected by their presence in outer space or on a celestial body or by their return to the Earth. Such objects or component parts found beyond the limits of the State Party of the Treaty on whose registry they are carried shall be returned to that State Party, which shall, upon request, furnish identifying data prior to their return.
Article IX
In the exploration and use of outer space, including the moon and other celestial bodies, States Parties to the Treaty shall be guided by the principle of co-operation and mutual assistance and shall conduct all their activities in outer space, including the moon and other celestial bodies, with due regard to the corresponding interests of all other States Parties to the Treaty. States Parties to the Treaty shall pursue studies of outer space, including the moon and other celestial bodies, and conduct exploration of them so as to avoid their harmful contamination and also adverse changes in the environment of the Earth resulting from the introduction of extraterrestrial matter and, where necessary, shall adopt appropriate measures for this purpose. If a State Party to the Treaty has reason to believe that an activity or experiment planned by it or its nationals in outer space, including the moon and other celestial bodies, would cause potentially harmful interference with activities of other States Parties in the peaceful exploration and use of outer space, including the moon and other celestial bodies, it shall undertake appropriate international consultations before proceeding with any such activity or experiment. A State Party to the Treaty which has reason to believe that an activity or experiment planned by another State Party in outer space, including the moon and other celestial bodies, would cause potentially harmful interference with activities in the peaceful exploration and use of outer space, including the moon and other celestial bodies, may request consultation concerning the activity or experiment.
Article X
In order to promote international co-operation in the exploration and use of outer space, including the moon and other celestial bodies, in conformity with the purposes of this Treaty, the States Parties to the Treaty shall consider on a basis of equality any requests by other States Parties to the Treaty to be afforded an opportunity to observe the flight of space objects launched by those States.
The nature of such an opportunity for observation and the conditions under which it could be afforded shall be determined by agreement between the States concerned.
Article XI
In order to promote international co-operation in the peaceful exploration and use of outer space, States Parties to the Treaty conducting activities in outer space, including the moon and other celestial bodies, agree to inform the Secretary-General of the United Nations as well as the public and the international scientific community, to the greatest extent feasible and practicable, of the nature, conduct, locations and results of such activities. On receiving the said information, the Secretary-General of the United Nations should be prepared to disseminate it immediately and effectively.
Article XII
All stations, installations, equipment and space vehicles on the moon and other celestial bodies shall be open to representatives of other States Parties to the Treaty on a basis of reciprocity. Such representatives shall give reasonable advance notice of a projected visit, in order that appropriate consultations may be held and that maximum precautions may be taken to assure safety and to avoid interference with normal operations in the facility to be visited.
Article XIII
The provisions of this Treaty shall apply to the activities of States Parties to the Treaty in the exploration and use of outer space, including the moon and other celestial bodies, whether such activities are carried on by a single State Party to the Treaty or jointly with other States, including cases where they are carried on within the framework of international inter-governmental organizations.
Any practical questions arising in connexion with activities carried on by international inter-governmental organizations in the exploration and use of outer space, including the moon and other celestial bodies, shall be resolved by the States Parties to the Treaty either with the appropriate international organization or with one or more States members of that international organization, which are Parties to this Treaty.
Article XIV
1. This Treaty shall be open to all States for signature. Any State which does not sign this Treaty before its entry into force in accordance with paragraph 3 of this Article may accede to it at any time.
2. This Treaty shall be subject to ratification by signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the United Kingdom of Great Britain and Northern Ireland, the Union of Soviet Socialist Republics and the United States of America, which are hereby designated the Depositary Governments.
3. This Treaty shall enter into force upon the deposit of instruments of ratification by five Governments including the Governments designated as Depositary Governments under this Treaty.
4. For States whose instruments of ratification or accession are deposited subsequent to the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession.
5. The Depositary Governments shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit of each instrument of ratification of and accession to this Treaty, the date of its entry into force and other notices.
6. This Treaty shall be registered by the Depositary Governments pursuant to Article 102 of the Charter of the United Nations.
Article XV
Any State Party to the Treaty may propose amendments to this Treaty. Amendments shall enter into force for each State Party to the Treaty accepting the amendments upon their acceptance by a majority of the States Parties to the Treaty and thereafter for each remaining State Party to the Treaty on the date of acceptance by it.
Article XVI
Any State Party to the Treaty may give notice of its withdrawal from the Treaty one year after its entry into force by written notification to the Depositary Governments. Such withdrawal shall take effect one year from the date of receipt of this notification.
Article XVII
This Treaty, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited in the archives of the Depositary Governments. Duly certified copies of this Treaty shall be transmitted by the Depositary Governments to the Governments of the signatory and acceding States.
Ratification
IN WITNESS WHEREOF the undersigned, duly authorised, have signed this Treaty.
DONE in triplicate, at the cities of London, Moscow and Washington, the twenty-seventh day of January, one thousand nine hundred and sixty-seven.

근현대 대체역사물이나 우주를 배경으로 하는 SF 작품을 창작하는 경우, 고증을 살리는 데 중요한 조약이다. 바로 행성천체에 대해 국가가 주권을 주장하는 것과, 외우주에서 대량살상무기를 배치하는 것을 금지하는 조항이 들어있기 때문이다. 이렇기 때문에 고증을 살리면서도 상기한 요소들을 집어 넣기 위해서, 우주조약 자체가 폐기 또는 사문화되었다는 것을 전제로 작품을 창작하는 사례가 매우 많다. 우주조약이 폐기되었다는 전제가 없으면 성립이 되지 않는 작품들이 원체 많다 보니 자연스레 발생하는 현상. 우주 조약이 아주 철저하게 지켜지는 세계관이라면 지구상의 국가들 끼리 우주 전쟁을 벌일 가능성이 원천 봉쇄되기 때문이다.
우주 진출이 가능한 기술력을 지닌 국가가 아직도 소수이고, 현 기술력 상으로 인간의 우주 진출은 제한적이기 때문에 유지되고 있을 뿐, 언젠가 기술의 급격한 발전으로 우주 진출이 일상화되는 시기가 도래한다면 폐기될 수밖에 없으며, 이미 이 조약을 체결한 당사자 3국 중 소련이 사라졌기 때문에 폐기될 명분은 충분하다. 소련의 후계국가라고 칭할 수 있는 나라들 중 하나라도 이것의 폐기에 동의하면 폐기될 수 있기 때문이다.
더 나아가 만약 인류가 우주에서 외계의 적대적인 세력과 대치하게 되는 상황이 온다면, 어쩔 수 없이 폐기될 운명이기도 하다.
